Today, many but not all of these illicit practices have been prevented thanks to the introduction of international safeguards such as the UN Convention on the Rights of the Child (CRC), Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption (1993 Adoption Convention) and Convention on Enforced Disappearances (CED). Enabling environments for such practices have been comprehensively outlined by the UN SR on sale and sexual exploitation in her landmark 2016 report.<\/p>\n<p>The impact of these illicit adoptions has wide ramifications for the adoptee, birth family and adoptive family, in terms of rights violations including preservation of identity, protection against sale, trafficking and enforced disappearances. International standards create obligations on States to provide Access to Justice and Effective Remedies (AJER) in response to such violations. Human rights, including transitional justice, require the establishment of truth; procedural justice and substantive outcomes such as restitution; compensation; recovery; reintegration and non-recurrence.<\/p>\n<p><strong>Webinar objectives<\/strong>:<\/p>\n<p>The first webinar is dedicated to State obligations and responses in past contexts, notably in terms of overcoming obstacles such as statutes of limitations and jurisdiction limitations. Aujourd&#8217;hui, bon nombre de ces pratiques illicites, mais pas toutes, ont \u00e9t\u00e9 \u00e9vit\u00e9es gr\u00e2ce \u00e0 la mise en place de garanties internationales telles que la Convention des Nations Unies relative aux droits de l&#8217;enfant (CDE), la Convention du 29 mai 1993 sur la protection des enfants et la coop\u00e9ration en mati\u00e8re d&#8217;adoption internationale (Convention de 1993 sur l&#8217;adoption) et la Convention sur les disparitions forc\u00e9es (CDF). Les environnements propices \u00e0 de telles pratiques ont \u00e9t\u00e9 d\u00e9crits de mani\u00e8re exhaustive par la Rapporteuse sp\u00e9ciale des Nations Unies sur la vente et l&#8217;exploitation sexuelle dans son rapport historique de 2016.<\/p>\n<p>Ces adoptions ill\u00e9gales ont des cons\u00e9quences importantes pour les personnes adopt\u00e9es, leur famille biologique et leur famille adoptive, en termes de violation de droits, notamment le droit \u00e0 la pr\u00e9servation de l&#8217;identit\u00e9, \u00e0 la protection contre la vente, la traite et les disparitions forc\u00e9es. Les normes internationales imposent aux \u00c9tats l&#8217;obligation de garantir l&#8217;acc\u00e8s \u00e0 la justice et des recours effectifs (AJER) en r\u00e9ponse \u00e0 ces violations. Les droits de l&#8217;homme, y compris la justice transitionnelle, exigent l&#8217;\u00e9tablissement de la v\u00e9rit\u00e9, la justice proc\u00e9durale et des r\u00e9sultats concrets tels que la restitution, l&#8217;indemnisation, le r\u00e9tablissement, la r\u00e9int\u00e9gration et la non-r\u00e9p\u00e9tition.<\/p>\n<p><strong>Objectifs des webinaires:<\/strong><\/p>\n<p>Le premier webinaire est consacr\u00e9 aux obligations et aux r\u00e9ponses des \u00c9tats dans des contextes pass\u00e9s, notamment en termes de comment surmonter des obstacles tels que les d\u00e9lais de prescription et les limitations de comp\u00e9tence. She represented the state of Western Australia and was a leading advocate for the State\u2019s significant geo-strategic and mining and energy interests.<br \/>\nBetween 2018 and 2022 she held senior Cabinet and other Ministerial portfolios in the Morrison Government in Defence, Government Services, National Disability Insurance Scheme, Defence Industry, Emergency Management and North Queensland Recovery.<br \/>\nAs a longstanding and passionate global advocate against human slavery and people trafficking, Linda continues to lead global reforms to combat orphanage trafficking and illegal intercountry adoptions.<br \/>\nSince retiring from the Australian Senate, Linda provides strategic corporate advice on the critical minerals sector, defence industry and the AUKUS alliance. She also speaks in Australia and overseas on contemporary defence, security, slavery and people trafficking issues and was a guest of the Ukrainian government for the 2025 Yalta European Strategy summit in Kyiv.<br \/>\nAs a graduate of Australia\u2019s senior military War College (CDSS), Linda holds a Master of Arts (Strategic Studies) from Deakin University and several other graduate and post graduate qualifications. She is a passionate advocate for the disability and veteran communities and sits on the boards of LegacyWA and SpinalCure Australia. She now serves as an Honourary Colonel Commandant in the Royal Australian Corps of Transport.
