August 2025, France : Draft resolution to guarantee every individual an effective right of access to their origins, presented by Ms. Géraldine BANNIER, Member of Parliament.

Draft resolution n°1167, submitted on March 21, 2025, by MP Géraldine Bannier, calls for a reform ensuring an effective right of access to personal origins. Relying on the case law of the ECHR (notably the judgment of September 7, 2023, Gauvin-Fournis v. France) and international instruments, it highlights the limits of existing mechanisms (CNAOP for children born under anonymous birth, CAPADD for persons conceived through gamete donation), where access remains subject to the express consent of biological parents or donors. The text emphasizes the need to adapt the legal framework to meet the expectations of individuals seeking information about their origins, and thereby promote their personal development. This proposal also invites the Government to lift this ban on private genetic testing, a move that could allow France to better align with international practices, and to legislate for an unconditional right to know one’s origins.

CHIP welcomes this initiative and share the view that this right should be recognized as fundamental, ensuring everyone can access their personal history.
